Shipping Policy

As your agent, we can assist in selecting a common carrier for the shipment of wine that you have purchased and own. The majority of states maintain laws and regulations that control or restrict the importation of alcohol. In all cases, the purchaser is responsible for complying with the laws and regulations, including in particular those relating to the import of alcohol, in effect in the state to which the purchaser is shipping alcohol.

Title to, and ownership of, all wine passes from seller to buyer in the State of California, and buyer takes all responsibility for shipping the wine from California to his or her home state. By placing an order, buyer authorizes seller to act on buyer’s behalf in arranging for transportation of the wine at buyer’s direction. Except for wine sold and shipped using seller’s direct shipping permits, sales tax will be applied based on seller’s location. Seller makes no representation as to the legal rights of anyone to ship or import any wines, alcoholic beverages or other goods into any state. The buyer is solely responsible for the shipment of wine and other goods purchased and for determining the legality and the tax/duty consequences of having the wine and other goods shipped to the applicable destination.

General Use Restrictions

All information, documents, products, software, and services (the “Materials”) provided on this Website were provided by or to Wineryship by their respective manufacturers, authors, developers and vendors (the “Third Party Providers”) and are the copyrighted work of Wineryship and/or the Third Party Providers. Except as stated herein, none of the Materials may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior express written permission of Wineryship or the Third Party Provider. No part of the Website, including logos, graphics, sounds or images, may reproduced or retransmitted in any way, or by any means, without the prior express written permission of Wineryship. You also may not, without Wineryship’s prior express written permission, “mirror” any Material contained on this Website on any other server.

Nothing on this Website shall be construed as conferring any license under any of Wineryship’ or any Third Party Provider’s intellectual property rights, whether by estoppel, implication, or otherwise. You acknowledge sole responsibility for obtaining any such licenses.

Wineryship sell products or services for children, but it sells them to adults, who can purchase with a credit card. If you are under 21, you may not use Wineryship. Wineryship and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

Materials provided by Third Party Providers have not been independently authenticated in whole or in part by Wineryship. Wineryship does not provide, sell, license, or lease any of the Materials other than those specifically identified as being provided by Wineryship.

Software Use Restrictions

Any software that is made available to download from the Website (the “Software”) is the copyrighted work of Wineryship and/or Third Party Providers. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software (the “License Agreement”). An end user will be unable to install any Software that is accompanied by or includes a License Agreement, unless the end user first agrees to the terms of the License Agreement. Except as set forth in the applicable License Agreement, any further copying, reproduction or redistribution of the Software is expressly prohibited.

SOFTWARE IS WARRANTED, IF AT ALL, IN ACCORDANCE WITH THE TERMS OF THE LICENSE AGREEMENT. Returns

Returns are the sole responsibility of the website user, customer or client. As a service to the client we can hold, redirect, return to sender an order so long as the website user communicates with Wineryship in a timely manner. Any delay in communication and the user will be responsible and bear the cost of any delay or mishap that may occur. 

Returns: 90 Day Rule

Return packages unclaimed will be held for 90 days before being disposed of by Wineryship. Packages being held at the request of the client will be held for up to 90 days unless an agreement in writing is reached for an extension of the 90 day rule.

Risk of Loss

All services rendered from Wineryship are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. Wineryship is not responsible for damages, delays or any other mishaps that occur after a shipment has been tendered to the common carrier. 

Pricing

Except where noted otherwise, the List Price displayed for services on our website represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The List Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. For certain items that are offered as a set, the List Price may represent “open-stock” prices, which means the aggregate of the manufacturer’s estimated or suggested retail price for each of the services included in the set. Prices are subject to change without notice and we are not responsible for typographical errors. Prices do not include applicable sales tax.

Please note that this policy applies only to products sold and shipped by Wineryship. Your purchases from third-party sellers using Wineryship are not covered in the privacy policy. Payments are charged at the time you place your order, and third-party sellers may follow different policies in the event of a mispriced item.
